Lord Young published his report on health & safety legislation on Friday (http://www.number10.gov.uk/wp-content/uploads/402906_CommonSense_acc.pdf)

 

One thing I noticed that will be of interest as winter approaches was this quote from the report:

 

"During winter 2009/10, advice was given on television and radio to householders not to clear the snow in front of their properties in case any passer by would fall and then sue. This is another manifestation of the fear of litigation. In fact there is no liability in the normal way, and the Lord Chief Justice himself is reported as saying that he had never come across a case where someone was sued in these circumstances."

 

The recommendations seem to make some sense, but we'll have to see what changes, if any, come about as a result.

    I can see some sense behind this as when the paths been cleared it may ice over unless you have put down rock salt. If some was to fall in front of someones property because the snow had not been cleared and there was a hidden obstical would they still sue !!!!

    I did read somewhere recently that the new government are planning to do something about this culture of sueing people for everything and always looking to blame someone....... I expect I'm like most people on here, if I slipped on a cleared footway, I'd just think I should have been more careful!....... I blame the americans myself lol.
