It is been brought to our attention over the last few months that the some within our Trade do not appear to know that some plants are VAT exempt.
All Fruit Trees VAT exempt are, along with most 1 litre Herbs.
Hope that this is of help.

Lavender is also VAT exempt
No sorry, not according to HMRC, Lavandula is not vat exempt. Please contact your local Tax Office for confirmation of this.
Lavandula is not a culinary Herb, so is not exempt from VAT.
We sell thousands of Lavandula each year in 1,2,3,5 & 10 litre, and charge Vat on all of them.
Thanks Paul,
VAT on Fruit Trees is not discretionary, it is a matter of fact. To confirm this it may be worth your while checking out the HMRC website, which is very clear on this issue.
It has been brought to our attention in recent months, as some Landscapers appear surprised that we state from the outset, all Fruit Trees are VAT exempt.
I have heard in the past of suppliers charging VAT on exempt plants. Obviously, I do not know how the supplier accounted for this in their VAT return or payment, or even inspection, but I do wonder?

Steve, is the vat on fruit trees a discretionary thing for supliers like the situation with VAT on safety wear or would a suplier be actually in the wrong with HMRC if they charged the vat on fruit trees.
Im certain Ive been charged vat on fruit trees in the past.
Spot on Nick, good work

See Vat notice 701/38 for a dfefinitive list of fruit trees and herbs and http://www.hmrc.gov.uk/manuals/vfoodmanual/VFOOD3500.htm for what they don't allow eg Bay grown in pots bigger than 2L or clipped etc.
Grass seed is also zero VAT rated.
That's interesting. Bought a lot of Lavandula last year from a local nursery and they didn't charge me VAT on the basis that it is a "herb". I may have to point out the error of their ways!
