Stolen name?

I've just had an email from a person informing me that she has just been ripped off by a company called DC Landscapes, same as us. They posted in her area and she had them in to do some tree felling. But then legged it with her money.I have the guys name and number, but don't want to call yet - don't know what I'd say. However, not happy about having someone else working in my vicinity using my name, doing shoddy work or even worse doing a legger with someones money.Any ideas on what I can do?Can I register as a LTD. company, something I've been thinking about doing, rather than a registered partnership. Will that protect my name if I can track these people down? Or is that likely to cost in court fees etc....

    No, not at all, she is fully aware that we are a different company, thankfully.
  • Yeah, two options, set the trap and get trading standards to do your spade work or set the trap and do your own spade work as it were! Either way, this would clear the problem then I would go with my own positive ad campaign if I felt needed.

  • You could register dc landscapes as a ltd company if the name is available with company house...
    Just beware that your accountant bill will serverly go up and various things like insurance will also increase..
    By going ltd will not stop anyone from using the name. Sorry.. You can't stop them.

    Ar$e. Bunch of buggers. Spend an age building up a reputation only to have it picked away by another company. I'll have to think about tactics on this one! I think give them some time to cool down, so they are answering their phone again and give them a call I think.
  • I'm a Ltd company but a gardening service company not far from me uses the same name!!!! Annoying but not breaking any law/rules.
  • We had a company start up near us with a very similar name. Thats why we are now Ouzel Landscapes. I had no choise but to change the name. Its a shame they ruined my reputation, but hey life must go on.

    Yes I think I will start with the Trading Standards route, it will be sooooo much hassle to change my name. We have built up a reputation with this name and it would mean rebranding the company entirely. New van sign-writing, new website, change bank account details, new printing of cards that I use on a daily basis etc...
