  • Id remove the 25+ element as It counts as age discrimination - you could replace with say "2/3" years industry experience needed.

  • Well said David. However I believe that you can state an age restriction (well preferred age limit) if it's related to say the fleet insurance policy requirement but don't quote me on this.

  • it is a grey area, insurance is not a valid case in equality law as it has no bearring on the ability of the person to do the job - If your insurance company specified "resident in the uk for x year" it would be racisit to use that in recuruitment as well as EU freedom of movement regulations prevent any discrimination their as well.

    You have the option of seeking out insurance or paying more to insure an appropriate sub 25y old candidate, or working around their age by noting having them drive, or paying them less to acount for this (IE simply 80% of salary until 1/2/3 years servic e beofe rising to 100%) these tend to be the common ways of working round these restrictions.

    Also, and I have seen this with plumbers etc - Own insurance requiered if you do not meet company policy - IE points on licence etc and then pay them a milage allowance as they use their own vehicle.

    Tread carefuly! Their as some good guides on the net to this, try ACAS they can help as can many accountants.
